EYou Electronics – RACOMTECH PTY LTD

By making a purchase from RACOMTECH PTY LTD, you agree to the following terms and conditions.

1. Payment Terms

Unless otherwise agreed in writing, payment must be made in full before shipment via PayPal, credit card, or bank deposit.

a) For orders exceeding A$3,000 or for test instrument orders, only bank transfer or PayPal payments are accepted. Credit card payments will not be accepted.

b) When paying via PayPal, the order will only be shipped to the mailing address associated with the PayPal account.

2. Shipping

  • All products are shipped FOB Melbourne, Australia to the buyer’s address.
  • Orders are shipped via TNT or Australia Post.
  • Individual equipment items weighing over 20 kg will be shipped freight collect by a carrier at our discretion.
  • For shipments valued over A$1,500, we strongly recommend purchasing shipping insurance.
  • Shipments must be inspected immediately upon receipt. If there is any damage, request the carrier to document the damage in writing.
  • The consignee is responsible for filing all damage claims. While RACOMTECH PTY LTD will assist in the process, our responsibility ends once the carrier acknowledges receipt of the goods in good condition.

3. Warranty

The limited warranties applicable to RACOMTECH products can be found in our Warranty Policy or in the documentation provided with our products.

4. Technical Support

RACOMTECH provides lifetime technical support for all products purchased directly from EYou Electronics / RACOMTECH.

This support includes assistance with operational queries via:

  • Telephone
  • Facsimile
  • Email
  • Web-based support

Note: Lifetime support does not cover products purchased from resellers or third parties, nor does it include on-site support.

5. Restocking Charges

  • Orders canceled during manufacturing but before shipment are subject to an 8% restocking fee.
  • Orders returned within 30 days of shipment are subject to a 12% restocking fee.
  • Custom products are non-cancellable.
  • After 30 days from shipment, all sales are final.

6. Delivery Dates

RACOMTECH will make commercially reasonable efforts to meet the buyer’s requested delivery date(s). However, RACOMTECH will not be held liable for failure to meet these dates.

If an order is canceled due to RACOMTECH’s failure to deliver, the sole remedy is the cancellation of the unshipped portion of the order.

No cancellation due to default will be effective unless:

  • RACOMTECH has been notified in writing of the default.
  • RACOMTECH has failed to correct the issue within 30 days of receiving written notice.

7. Limitation of Liability

If RACOMTECH is found liable for any damages, our liability is strictly limited to the total amount paid for the product or service in question.

This limitation applies to:

  • Subcontractors, resellers, programmers, and developers involved in the transaction.
  • Third-party claims, including lost profits, data loss, or consequential/incidental damages, even if RACOMTECH was advised of potential risks.

RACOMTECH is not responsible for:

  • Loss or damage to the buyer’s records or data.
  • Indirect, incidental, or consequential damages, including lost savings or profits.

8. Warranty for Free Software

RACOMTECH may provide software licensed free of charge. As such, this software is provided "as is", without any warranties, expressed or implied.

This includes, but is not limited to, implied warranties of merchantability or fitness for a particular purpose.

  • The entire risk regarding software performance lies with the user.
  • RACOMTECH is not responsible for software defects or any associated repair costs.
  • Under no circumstances shall RACOMTECH be liable for damages arising from the use or inability to use the software, including data loss, inaccurate data, or compatibility issues with other software.
